Trump to Cruz: Settle eligibility question or 'get out' of the race

Donald Trump stepped up his attack on Ted Cruz on Monday, tweeting that the Texas senator needs to "either settle his problem" of having been born in Canada or leave the race.

"It's time for Ted Cruz to either settle his problem with the FACT that he was born in Canada and was a citizen of Canada, or get out of race," Trump tweeted Monday morning, on the heels of Fox News polls released over the weekend that showed him with double-digit leads over Cruz in both Iowa and New Hampshire.

Trump has insisted over the course of the last month that Cruz needs to tackle the issue of his eligibility because he was born in Calgary, Canada, despite Cruz's assertions that he is eligible based on the fact that his mother was born in the United States. Cruz renounced his dual Canadian citizenship in 2014, a fact that Trump has frequently pointed out as cause for concern.

I don’t have a problem with that. Trump may cross the 50% line.

This eligibility issue is hanging over Cruz’s head.

I am familiar with declaratory judgments which typically involve disputes over insurance policies where a policyholder sues an insurance company to get a declaration of rights under the policy. Again, are you an attorney because I would like to read your expertise on the question of how Cruz would be able to sue himself. Could you site me any case where an American court has ever ruled on a declaratory judgment where the plaintiff sued himself as the defendant. I would be very interested in reading the decision on such a case.

I think one has to admit that regardless of the merits of the eligibility challenge, this question creates a real chink in Cruz’s inevitability.

But many state laws do.

If a state requires the candidate to be qualified then a determination by the state that he isn’t presents a judicial issue, several even.

Just to address the first two:
  1. Trump is pro-life by his own definition, which is "with exceptions for rape, incest and risk of the mother's life". Who in the pro-life community calls that pro-life, exactly? Sounds more like Pelosi's "rare but legal" mantra.
  2. Planned Parenthood named Trump their "Favorite Republican". That speaks volumes to those who have hears to hear.

Who the hell is Trump to tell anyone to get out of the race? Screw Trump and his arrogance and ego. The more Trump bleats, the more voters he turns off.

He’s posted his Canadian birth certificate but not his Consular Report of Birth Abroad. Why not? Or did I miss it? (Essentially his American birth certificate documenting American citizenship.)

You need to dig in to the federalist papers and other writings of the founders, what you discribe is exactly what the founders meant. Trump is wrong.

He seems to already be. Levin’s Facebook page is an hourly exercise in negative Trump postings. The man seems to be obsessed with all things Trump and the comments on his page from supporters, mostly Cruz supporters are really inappropriate for a public figure of his statue. You’re watching a meltdown real time.

Cruz has a stake, and is involved in multiple suits now. I mean, Cruz has "standing" although that notion is nonsense when looking at a defendant.

There is at least one case, "Prag", who is an opponent on the ballot, where plaintiff has standing in the traditional sense.

You have absolutely no idea what you’re talking about. A lawsuit doesn’t prevent a declaratory judgment.

The fact is that “people” have no value as binding legal precedent. It takes an actual court case at the level of the SCOTUS and one does not exist. When and if the question is resolved it will be resolved on the basis of evidence of the intent of the Framers at the time that the phrase “natural born citizen” was inserted into the Constitution and ratified in the individual states. Subsequent statutes and the Fourteenth Amendment will not be looked to.
