Donald Trump stepped up his attack on Ted Cruz on Monday, tweeting that the Texas senator needs to "either settle his problem" of having been born in Canada or leave the race.
"It's time for Ted Cruz to either settle his problem with the FACT that he was born in Canada and was a citizen of Canada, or get out of race," Trump tweeted Monday morning, on the heels of Fox News polls released over the weekend that showed him with double-digit leads over Cruz in both Iowa and New Hampshire.
Trump has insisted over the course of the last month that Cruz needs to tackle the issue of his eligibility because he was born in Calgary, Canada, despite Cruz's assertions that he is eligible based on the fact that his mother was born in the United States. Cruz renounced his dual Canadian citizenship in 2014, a fact that Trump has frequently pointed out as cause for concern.

To my knowledge, those cases so far have been in state courts. I limited my discussion to federal courts, which are the only ones that can rule on this issue.
I also believe Cruz can get a hearing on several court filing if he had the balls to file them given the current impact this debate is having on his campaign.

We were taught in school that to be eligible to serve as President, one must be born on US soil to 2 US citizen parents.
I just asked my daughters (Cruz' age and younger) what they were taught and it was born on US soil. Nothing about parent citizens.
So the anchor baby argument is being taught in public schools and colleges BUT not if not born on US soil.

The Schwartz case was filed in a federal court. He lacks standing.
State courts have an interest in ballot integrity, and can remove unqualified candidates from the ballot. If that is improvident, the candidate can take the issue to a federal court. Well, he can take it federal court, improvident or not - the argument is that the removal was improvident.
Ted Cruz has more troubles then Donald Trump. According to the U.S. Citizenship and Immigration Services, those who automatically acquire citizenship are not required to obtain any such certificate.
True, but before he can take it to federal court, the state court has to remove him from the ballot - otherwise, he has suffered no injury. To my knowledge, none of those states have removed him.
You didn’t refer to any such situation. You referred to the courts.
To even get a serious case in a state court, some state’s secretary of state would have to disqualify him from the ballot. Even then, a court might doge the issue by calling it a political question.

We're on the same page. Until he has been denied something that he has a right to, he has no beef. All the citizenship suits start with being denied citizenship, usually by some administrative bureaucrat. Being denied access to the ballot is a similar deprivation.
Meanwhile, he has an interest in the ballot access suits, and his arguments will be considered.

I agree with that, although dodging the question puts the court in a position of tolerating a ballot with potentially ineligible candidates.
The RNC can disqualify him without engaging a court. That would be an issue before the nominating convention, and be independent of election contests.
