Trump to Cruz: Settle eligibility question or 'get out' of the race

Donald Trump stepped up his attack on Ted Cruz on Monday, tweeting that the Texas senator needs to "either settle his problem" of having been born in Canada or leave the race.

"It's time for Ted Cruz to either settle his problem with the FACT that he was born in Canada and was a citizen of Canada, or get out of race," Trump tweeted Monday morning, on the heels of Fox News polls released over the weekend that showed him with double-digit leads over Cruz in both Iowa and New Hampshire.

Trump has insisted over the course of the last month that Cruz needs to tackle the issue of his eligibility because he was born in Calgary, Canada, despite Cruz's assertions that he is eligible based on the fact that his mother was born in the United States. Cruz renounced his dual Canadian citizenship in 2014, a fact that Trump has frequently pointed out as cause for concern.

A Democratic member of the U.S. House vowed Thursday to file a lawsuit challenging Sen. Ted Cruz’s Constitutional eligibility to become president.

Rep. Alan Grayson, Florida Democrat, said the issue is not political but Constitutional and that he will file a suit “if and when he becomes the nominee and tries to qualify for the ballot” in November.

God may have other plans. I often reflect on the OT. The prophet comes by and tell them they will be captured and carried away. How did the average person respond, we know how the leaders did.

Cruz has powerful procedural arguments, in addition to the standing argument. Essentially he says that lower courts lack jurisdiction, and that the issue isn't ripe until after the election contest has been decided by Congress.

There are ways to pierce those arguments, but courts do not want to be the deciders. I think some judge is going to want a place in the history books. Not sure how far the issue goes, in the courts. Federal courts will universally facilitate evading the question on the merits.

To Trump it doesn’t matter that it’s not resolvable, it’s the attack that’s important and to keep discussion about Trump’s contributions, endorsements, previous stands on issues. Not to mention what may be in store for us with his deal making. I don’t trust Trump and I have real doubts about his new found Conservatism.

Grayson doesn’t have standing. He is just a vote counter, and can challenge electoral ballots, if he wants.

You mean, an expert on the Constitution is unable, with the wave of his hand, to allay all fears about his eligibility? Releasing all necessary documentation, such as the forms that should have been filed with the United States government by his mother shortly after his birth in Canada? Describe what documentation he has used all his life when a birth certificate, or proof of citizenship, is required? I don’t understand the reluctance. I noticed during the debate he chose to laugh it off with sarcasm and inaccuracies. Never engaged a legal argument, other than “I am eligible”.

I think he would. Remember when Rep. Synar filed that lawsuit on the un-Constitutionality of Gramm/Rudman/Hollings back in teh day? I “think” the court determined that as a US Rep., he in fact did have standing.

But this is sure testing the memory....

Hah! You nailed him. He just loves to tweet. I’ve often said that he tweets more than a teen-age girl with a crush.

Someone ought to gather up all his tweets so we could read them.

The point is he does need to settle it..Cruz is a lawyer... he should be able to put together the facts with the law ...in other words his case and get this settled up front......he need to eliminated anyone can have and standing to challenging meeting the constitutional requirements of present... he needs to preemptively challenge himself.

This should not be so hard...if its not black and white in the law ..if there any gray...then Cruz need to take it to court and get a ruling before not after....its CYA.... McCain did it in 2008

Im dealing with something like this in business someone has potential tax liability... and they assure me there's no problem....and I've told them "then get that settled and show me before I do any business with you" if you not willing ...your really not sure there nothing there

...if you are so positive that your beehive has no bees.. you go kick it and show me...why are you tip toeing around things?

The RNC needs to ask the Supreme Court for an expedited ruling.

...anywhere else, the decision just gets appealed.
