Trump to Cruz: Settle eligibility question or 'get out' of the race

Donald Trump stepped up his attack on Ted Cruz on Monday, tweeting that the Texas senator needs to "either settle his problem" of having been born in Canada or leave the race.

"It's time for Ted Cruz to either settle his problem with the FACT that he was born in Canada and was a citizen of Canada, or get out of race," Trump tweeted Monday morning, on the heels of Fox News polls released over the weekend that showed him with double-digit leads over Cruz in both Iowa and New Hampshire.

Trump has insisted over the course of the last month that Cruz needs to tackle the issue of his eligibility because he was born in Calgary, Canada, despite Cruz's assertions that he is eligible based on the fact that his mother was born in the United States. Cruz renounced his dual Canadian citizenship in 2014, a fact that Trump has frequently pointed out as cause for concern.

He doesn’t want elections, no competition, no attacks from his opponents on past statements. Who does he think he is...king? This should prove worrisome to any patriotic American.

Cruz couldn’t be proactive. In order to get a declaratory judgment from a federal court, an actual case in controvery must exist. Federal courts don’t issue advisory opinions. So Cruz couldn’t just ask the court’s opinion.

He goes for a declaratory judgment once some government actor denies his eligibility.

Just saying, you are right, he can't sue to get something that he already "holds," even if it is improvidently granted or held. And it's nonsense to sue (the government) to have it taken away!

He has to play this by the adversarial rules, including all procedural challenges. Out legal system is adversarial, and he has a right to defend his claim.

if Cruz is found to be legally ineligible and obozo’s Hawaii birth cert is clearly a fraud, where will that leave the obozo and all of his actions as president?

Here is the possible danger: Assume Cruz wins the GOP nomination. In the general, at a time late in the election a Democrat operative (any one of the 14 Dems) uses a democrat federal judge to get a preliminary injunction against Cruz (Very likely with past history). There will be no GOP candidate since we do not elect the VP. Thus it will fall to the next highest vote getter OR the incumbent will stay on until the Courts sort it out.

Thats a very bad possible result that Cruz can prevent now as he has standing and can ask for a declaratory opinion now eliminating this danger.

After Cruz does what???? Excuse me, it wasn’t Trump that was ‘taking the oath of President’ on that stage with ‘nut job’ Beck...wonder if Beck gave Cruz a set of the ‘magic garments’????

Cruz knows something is not right about his NBC or he wouldn’t have sealed his records...sounds familiar doesn’t it???

Not any more. He formally renounced his Canadian citizenship. I do believe he still has a valid claim on Cuban citizenship at birth, being born abroad of one Cuban citizen parent.

I want a pony, but sometimes we don't get exactly what we want. Next time run a religious icon or preacher if that's what ya want.

Trump is the best guy on the stage and more Americans support him than any R candidate. That's good enough for me.

Yes, I am very concerned about that.

I have stated that this NBC controversy is not helpful to me as a voter at all knowing that if I choose to vote for Candidate X, and then at some later point candidate X is ruled ineligible, my vote was wasted.

I want this matter resolved one way or the other.

If Ted is good to go, then say it. If he’s not, then he’s not. Let’s get this matter settled.

Actions of a person improvidently seated are found to be VALID using a de facto officer doctrine. There is no unwinding the past, that would be chaotic, counterproductive, bad for all of us, etc.

Trump DOES have a point. Many, many of us had it drummed into us in civics classes throughout our school years that NBC was 2 citizen parents born inside the country. We would talk about who in the class was born abroad and not eligible. And now, one day it is okay because someone said so?

Who else remembers?
