What about Hillary?

Carter does not have any jurisdiction over Hillary. He is in charge of the armed forces. So he can only hand out punishments for military personnel. His responsibility does not include the state department at all. The State Department is a separate department from the Department of Defense. They do work together occasionally which is why you may have thought Carter could do something.

Ash Carter should remember always that the next American administration will have jurisdiction over Ash Carter (and her Imperial Entitledness and the Emperor from Kenya), if he is really so in love with retroactive judgment in matters already decided.
