Trump won’t drop birther question, and Ted Cruz is fighting back
McClatchy DC ^ | January 10th, 2016 | By Maria Recio

WASHINGTON -

Canadian-born Sen. Ted Cruz, R-Texas, continued to come under fire Sunday over whether he is a “natural born citizen” eligible to be U.S. president.

Cruz, a lawyer, has said that his citizenship is “settled law” and on CNN’s State of the Union on Sunday said it is “clear and straightforward” that he became a U.S. citizen at birth in Calgary because his mother was a U.S. citizen. His presidential primary campaign even released his mother’s U.S. birth certificate over the weekend - after denying she had become a Canadian citizen, although her name appears on a 1974 Canadian federal election voter roll.

But Republican national frontrunner Donald Trump, who stoked the issue last week by saying that Democrats would sue if Cruz was the nominee and ensnare the election, continued to press his case on several Sunday news programs that the foreign birth was “a problem” that the Supreme Court ought to decide.

Asked about his eligibility as a citizen on CNN Sunday, Cruz said, “The substance of the issue is clear and straightforward. As a legal matter, the Constitution and federal law are clear that the child of a U.S. citizen born abroad is a natural-born citizen.”

Cruz was born in Calgary, Alberta, in 1970 when his Cuban father, Rafael Cruz, and American-born mother, Eleanor Cruz, were living and working in the oil industry. However, his father became a Canadian citizen, as Rafael Cruz told NPR in 2013. And both his and Cruz’s mother’s names appear on Canadian voter rolls in May, 1974, in documents obtained by McClatchy. Only Canadian citizens are eligible to vote in that country.

Then you're arguing with the Government of the USA; not me.

And the Constitution quote was later changed.

The electoral rolls were more of a census, and identified residents from whom the pool of legitimate voters was drawn.

Cruz, Rubio, Jindal, and Obama aren't eligible.

Of course, Obama was shielded by the Dems and the MSM. There IS a double standard, alive and well in this country; sadly.

The dems will not challenge Cruz unless he gets the nomination.

It does not matter, because Ted Cruz acquired U.S. citizenship by using the U.S. statutory laws of the naturalization Act. The Constitution granted the Congress the power to enact a uniform system of naturalization law, but it did not and could not possibly grant the power to naturalize a natural born citizen. Therefore it is quite impossible for Ted Cruz to be a natural born citizen, because the U.S. Government does not have and cannot have the Constitutional power to naturalize as a citizen a person who is already a natural born citizen.

What about the situation of Post #38 regarding the princes of Queen Noor of Jordan? They too are NBC?

It’s has already been decided. Persons in Cruz’s situation are naturalized citizens.

Persons who acquire citizenship via federal statute can lose their citizenship if they fail to fulfill statutory requirements (Rogers v. Bellei, 401 U.S. 815). A citizen under the 14th Amendment can not have their citizenship revoked (Afroyim v. Rusk, 387 U.S. 253).

That which is granted can be taken away.

Congressional grants are naturalization.

Obviously, this isn't something widely known about. I know about it because I know a many who became a Naturalized Citizen 10 years ago. His wife was pregnant at the time and once he became a citizen, he was thrilled that his child could now run for the presidency, when he was born and grew up.

The government hands out study guides, for the citizenship test and this info was in that study guide.

I wish SCOTUS could be relied upon, but I’m kinda fearful about that. Scalia, Thomas, & Ito- I trust completely. Roberts is Cruz’s buddy & he hasn’t worked out well at all. Who KNOWS what he would do? The others are lefties, or proto-lefties & wouldn’t mind a bit seeing the country vulnerable to revolutionaries.

Now maybe the dominionists think they can prevail over the communists; maybe they can & maybe they can’t- but it is not right that they would inflict this on the rest of the nation, willingly & unnecessarily. I’d like to see The South secede, too, but I wouldn’t put the whole country at risk to do it- not unless it was a matter of survival. *These things are not predictable.* They are playing a VERY dangerous game with the lives of every American.

ps In context, Cruz, Sr being up to in his neck in this doesn’t surprise me a bit. 20-20 hindsight, once a revolutionary, always a revolutionary. Some people just like to watch the world burn.

It didn’t shut me up!
I was screaming about the fact that his purported father ( does ANYONE really know WHO his father was ? ) wasn’t a citizen of the USA, so waee barry was NOT a NBC.

This is the point, providing she never relinquished her American citizenship, then her little princes have the same ability to be President as does Sen Cruz according to some here on the forum.

Yes a NBC one, whose family had been NBC for generations.
The baby was born here, to boot.

But THAT is the point, she couldn’t marry the King, nor become Queen if she hadn’t renounced her American citizenship.

waee barry was NOT a NBC.

And is still not, I've always believed that. I guest that pretty much solidifies my position on the whole thing. Now it looks like Trump, Jeb or that wacko from Iowa. I guess you could throw Carson in there, but I'm going with Trump.

I don't see how it could be to Cruz' advantage to take it on later rather than sooner.

Because it hasn't become necessary, nor has it reached it's potential for damage.

Turn this around on Trump now, and he has time to recover... wait another week or 10 days, and it becomes disastrous.

That's the thing with tar babies.
