I didn’t mean to imply that it’s a law, just how it’s commonly done.

In some states, that may be how it’s done by law if the deceased had no will; but with a will, there’s no requirement to do it that way.

Not exactly. In some states you cannot legally cut your spouse and/or your children out of the will.
