Can someone explain how the president can change state and federal laws to make murdering a police officer a capital offense?
First of all, I’m not against the idea, but it is something that needs to go through congress and state legislatures before it becomes law.

I’m pretty sure there’s already a law to that effect. However they then refer it to the Feds, who won’t act on it. They don’t need an EO, just enforce the law as written.

The reason for the refer to the feds is that the courts have ruled that only the Feds can enforce immigration laws (i.e. deport). Authorizing and empowering local LEO to deport would be a huge game changer.

that’s different (but the death penalty itself cannot be imposed by executive fiat, it has to already exist properly in law... etc....and conform to constitutional standards)

It would have to go beyond the LEOs. Someone has to handle the detention, deportation hearing and actual deportation. LEOs can arrest, but you would need a whole new state bureaucracy to handle it. Which isn’t necessary if the Feds just do their job and cooperate with the states to enforce the law.

Looks like Trumps thinking he can do as Obama has and by-pass Constitutional law.....and perhaps even Congress.... He's done as much in his own life with the team of lawyers always at his side to get through the loophools regarding his businesses etc. and Obama has certainly shown nobody stopped him....though some have tried.
