Politico reported earlier in the evening that a pro-Kasich super PAC was planning to unload $2.5 million or more to take down Trump, the Republican front-runner, in New Hampshire.
This prompted a dozen-tweet barrage by Trump against Kasich, ripping the PAC's attack as "pathetic" and calling the governor a "dud" over the report, among many other things.

The super PAC, New Day for America, published a letter from The Trump Organization's lawyer warning that Trump would promptly seek "legal action" against the committee if its ads lied about Trump.
"It has come to my attention that you plan on producing and disseminating certain radio, television, and newspaper advertisements directly and personally attacking my client," Trump's lawyer, Alan Garten, wrote in the letter, which was also addressed to the Kasich campaign.
"Please be advised that in the event your ads contain any false, misleading, defamatory or otherwise tortious statements or representations concerning Mr. Trump's business or his brand, we will not hesitate to seek immediate legal action," it continued.
The letter concluded: "Please be guided accordingly."
The letter was similar in nature to a September cease-in-desist letter The Trump Organization sent to a conservative group, the Club for Growth, that ran attack ads against Trump in Iowa. Some eyebrows were raised because the letter was sent from Trump's corporation rather than from his campaign.

Trump is a master of getting things done, he knows how to talk to people, he has dealt with politicians all his working life, he knows how they think and he knows what they are going to do before they do it...by then, it's to late....
I am willing to support the man....he wouldn't be where he is today if he wasn't a genius...and I don't want another ‘politician’ to lead this Country, I want a hard worker that have come up thru the ranks and done what he has to do to get where he is, and in my opinion that is Trump....
He knows a lot of great people, he surrounds himself with honest people, and he is as honest as the day is long...

Then Kasich’s lawyers have nothing to worry about, right? So everyone should shut up since it won’t matter.
They clearly have an arrangement that I'm sure carries well past the nominating process.
And since Ted is stuck 20 points below Donald with 70 days left, he's not going to make a miraculous recovery. Be glad Ted will be veep or AG.
Trump's legal tactic in this case is blowing hot air.
That’s certainly what I took from it. Sort of a shot across the bow. And, based on what Trump always says, you never tell someone what you’re about to do. So, if Trump really were planning to be serious with a case like this, he’d smack Kasich out of the blue.

Good post. GWB never responded to his critics to show he was thick skinned and he got crucified. Some say Trump is thin skinned but I say that we finally have a man who will fight.

Yes, I get that. It certainly makes sense if you, the candidate who is trying to knock out your opponent, is the direct beneficiary. Kasich is dead letter. He isn’t going anywhere. What this add campaign is about is Kasich and his PAC acting as the GOPe’s suicide bomber to take Trump out. Yes, I said suicide bomber. It will exhaust all of Kasich’s funds and, at the end of it all, Kasich will still be a nobody of a candidate with no chance dropping out of the race. But by goodness, he will have done the Jeb! loving GOPe’s bidding to a tee.
I have no problem with hardball politics. But this cycle I am mistrusting of the entire process because I am certain that the GOPe will NEVER stop trying to shove a cheap labor express asshat down our throats. I oppose that and if it means eschewing hard ball, then so be it.

Should the defamation fall outside the listed constraints, then it becomes a battle of the lawyers, should they decide to waste each others money. Otherwise, all they can do is to publically refute the defamation. Hell, the rats do it all the time. Meanwhile, the little guys who cannot afford to waste money on litigation have the web and other media sources to hopefully support their position. I think loser should pay, no matter the chilling effect it might have.
