Thursday, Republican presidential candidate Jeb Bush criticized his rival Donald Trump's plan to deport 12 million illegal immigrants living in the United States, saying their legal right to "due process" would make Trump's plan "not possible."

They are entitled to 5th amendment substantive and procedural due process through the 14th amendment.

But neither gives criminals immunity.

Find them, determine their status—if they are here illegally, boot them out. Due process satisfied. They can conduct their appeal from their home country.

Hey Jebster, most of these parasites will self-deport. The dregs, incarcerated and indicted will get rounded up and deported.

Trump will aggressively enforce E-Verify and prosecute employers who have illegals on staff. He will also end anchor baby status and toss them out of Obamacare and other “entitlements”.

Once the magnets are turned off they will self-deport out of a sense of survival.

We gave Elian Gonzalez back to Castro, which proves due process only applies to citizens.

All others are not subject to the jurisdiction of The United States and may be immediatley removed for and with cause.

Besides, they are trespassing

Yes it does. The amount and nature of it vary, depending on the accused and the accusation, but there is always some amount of "due process."

Recall all the litigation surrounding Gitmo when Bush was president. "Due process" is a significant part of the argument.

Maybe so. When we prosecute foreigners who commit crimes here they have rights, correct?

Due process is applicable only to those that have rights under the Constitution. Illegal aliens have no such rights.

At the very least we should be tracking down each illegal immigrant to:

(1) Determine and record their identity.
(2) Establish their address for tracking purposes.
(3) Investigate their work history and if they have been paying taxes.
(4) Determine if they have broken any other laws while in the US.
(5) Establish whether they have a history of violent crime and whether they are potentially dangerous criminals who should be immediately jailed.
(6) Check for affiliations with terrorist groups.
(7) Examine them for communicable diseases.

(Feel free to add your own items to the list...)

As long as we’re taking the actions above, why not deport them?
