I think a way around this is to state clearly on the employment application that the job entails delivering alcohol. Them there is a question that asks, “Is there any reason you cannot comply with that job requirement? If the answer is YES, the position cannot be performed by you and therefore we cannot offer you the position.”
Another line states clearly that “Any untrue answer on this application may result in disciplinary action against you, up to and including termination.” So, if they lie and say they CAN fulfill the requirements of the position (i.e., deliver alcohol), then later claim their religion prohibits delivering alcohol, that would go a long way to defeating an EEOC charge.
One of the major problems this country has is it created out-of-control agencies such as the EPA and the EEOC that have finagled to themselves pretty much unbridled powers.
I agree. That does seem like the right way to word it on an employment application.
And yep, all of our little “alphabet” agencies have become too powerful for their own good. Who would have ever imagined growing government and growing government agencies would ever lead to such a thing?
