You can’t take away pre-existing rights. The B.O.R. merely RECOGNIZED those rights that we already had. Also, the ratification of the Constitution itself was based on a promise to send a B.O.R. to the states for ratification. Abrogate ANY of them, and the Constitution itself is void.
I’m pretty sure that you know this, but it still needs to be stated.
