In the end legal positivism = tyranny of a fickle majority.

Legal positivism has no fundamental essence of establishing/defining justice and virtue which are the building blocks of a prosperous (Materialism plays a very minor part) society.

Agreed, but you must acknowledge that our current jurisprudence is based upon this positivism (along with a healthy dose of utilitarianism)
