This is an interesting situation because the courts thrust themselves into a political issue where they have no business and no competence. The courts have created a mess, and people are going to disobey the courts. To the extent the courts get heavy handed (like jailing people), the courts will become more open enemies of the people, with nowhere but platitudes to turn for help or legitimacy.

I don't know if Bunning had an epiphany, or if the 6th Circuit did. But on bedrock judicial principles, incarceration is an inappropriate remedy for conscientious objection.
