I've been hearing about this for what seems a couple of weeks now so, not being a lawyer or as complete a Constitutional scholar as I hope to be, I have to ask is this protected free speech under the First Amendment, or is this analogous to Oliver Wendell Holmes, Jr.'s "shouting fire in a crowded theater" metaphor and perhaps subject to prosecution?
