The "extremely serious" investigation into Hillary Clinton's use of a private email server while she served as secretary of state is being led by an FBI "A-team," an intelligence source told Fox News.
The source said the investigation is centered around 18 US Code 793, a section of the Espionage Act related to gathering and transmitting national-defense information.
Two emails reportedly found on Clinton's server from 2009 and 2011 contained information regarded as "Top Secret/Sensitive Compartmented Information," one of the highest levels of classification.
The two emails were drawn out of a batch of 40 randomly selected from about 30,000 "work-related" emails that Clinton turned over to the State Department from her time as secretary of state, from 2009 to 2013.
Some of the information — such as communications intercepted via satellite or drone — is protected under the law 18USC798, which means they have tighter rules and higher penalties.
Massimo Calabresi of Time recently noted that the law "makes it a crime not just to knowingly mishandle such secrets, but also to use them 'in any manner prejudicial to the safety or interest of the United States.'"
As a result, the FBI's investigation has gone "way beyond what the intelligence community's Inspector General ever would do," a senior intelligence official familiar with the case told Time.
Earlier this month the New York Times shed light on the FBI's "unusual" decision to run the investigation out of its headquarters in Washington, DC.
"Nearly all [FBI] investigations are assigned to one of the bureau’s 56 field offices," according to The Times.

Sounds good, until you realize the definition of “what’s in the interest of the US” has now been altered to “committing suicide”. Thus, if the goal is to destroy the US, compromising its intelligence and classified information” is actually good for the US.
Case closed. Not guilty.

Your take that this is about a Supreme Court position for Mooch or Barack is very interesting.
If this occurred, wouldn’t it be the first time a Supreme Court Justice was appointed whose law license had been forfeited or suspended? Which happened to Barack or to Michelle has never been entirely clear, but they are no longer members of the Bar.
My take is that they are monitoring the polls. Hillary is neither liked nor trusted by the electorate. If it looks like she can’t win, I’d say she’s outta there... whether by investigation, indictment, or self-declared health issues. Further, there is the issue of who to put in, and when. My money is not on brain-damaged Biden, nor on Sanders. I think Warren will be drafted.

You forgot the other 31,000 “personal” (i.e. “blatantly corrupt and treasonous”) emails she deleted, bringing the actual totals into the tens of thousands.

I very much doubt that. And in the event they did, it would be to get her off, not to convict her. Hillary is not worried, she does the kind of things that would get others life in prison day in and day out. Nothing of a legal nature has happened to her in 45 years of doing the same thing she has been doing day in and day out. The only time Hillary will face justice is at the Great White Throne Judgment.
However, when even a left-ish website gets into the details of 18USC798, perhaps ( IMHO ) that this is a warning sign the defecate is about to hit the rotary oscillator...
Head fake to Biden. Prosecution begins on Hitlery. Biden “bows out” without the energy, loss of son, etc. Enter O”Malley and former VA. Sen. Jim Webb. It could happen and the inside the beltway bandit lib-0hs would love it, as well as the mil-indust-medical complex beltway types and media.
Hillary will end her campaign “for health reasons” and pass the torch to Biden/Warren or O’Malley/Warren organization. All investigations and charges will be dropped and the media will never say another word on the subject.
