Ann Coulter pointed out a huge item that hasn’t been discussed in that opening of the 14th amendment. She highlighted BOTH “subject to the jurisdiction thereof” BUT she also highlighted “of the state in which they RESIDE.”
RESIDE is a legal term and not just describing where you might have laid down your sleeping bag last night.
It is talking about RESIDENCE in a state.
Question: if an illegal alien has a child in the US they receive a birth certificate from the hospital and it is registered with the State Records office. When they need a passport for the chikd, they just have to send the US state registered birth certificate, a photo and money to the State Department. There is nothing on the application that asks if the parents are citizens. So how can this process be stopped? Are we going to ask hospitals to prove citizenship of the parents?
I recall when we had a real immigration system and the kids parents had to assimilate (learn English and pass the citizenship test)and children they had here were natural born as both parents were then US citizens. A number of the men I served with had parents who went through Ellis Island. Whether Polish, Irish, or Italians they all paid their dues. Had we not allowed Ted Kennedy to screw up the Immigration Reform Act of the 60’s we would not have people here from countries we never allowed here before.
It is talking about RESIDENCE in a state.
Oh so true, dear brother in Christ! Illegal immigrant mothers who come to the United States to have their children (so as to make them instant "citizens" of the United States) are not residents of the U.S. or of any State.
Plus they owe no allegiance to the United States. Certainly, their children do not.
Much more to say on this issue. Maybe I'll get to it this afternoon.
Exellent point.
