The problem is that Hillary is not only violating the law by passing classified information through that private server, but also by erasing the server, she is obstructing justice. In short, she could get hit pretty hard legally.
She SHOULD get pretty hard legally - it's clearly a crime. If she was in the private sector they would have fired her and the gov't would take her up on charges.
