What many people want to ignore ,intentionally or unintentionally, including the Fox network judge, are the included wording/requirement of the 14th ‘and subject to the jurisdiction thereof’. When a parent takes an underage child especially a newborn baby back to their country of citizenship with no intention of having the birth countries laws apply to that child, the child cannot claim citizenship of the birth country as applies to US law.

Thank you for referencing that article jimbo123. Please bear in mind that the following critique is directed at the article and not at you.

"Birthright citizenship" is the idea, introduced in the 14th Amendment, that people born on American soil are automatically American citizens.

Just as with the perverted interpretation of the 14th Amendment by pro-gay activist justices to argue that gay “marriage” is constitutional, key wording in the 14th Amendment concerning birthright is likewise being ignored on behalf of illegals.

14th Amendment, Section 1: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside [emphasis added]. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Well there is a law that has been mis-applied for 75 years or so.

How about it applies to recently freed slaves and native Americans.

Not illegal aliens of late (as in 40 years)

Shortly after Donald Trump released his immigration policy proposal on Monday, Wisconsin Gov. Scott Walker assured reporters that he agreed with Trump's opposition to "birthright citizenship."
Says it all right there about the phony "me too" Koch snorting frauds.

2 weeks ago his mouth piece was calling Trump names, NOW, Walker can't wait for Trump's next move so he can ask what did Trump say? Oh yea,"me too".

Really? So the American people have no say in how the country is run? Only the corporate elites and America-hating Left get a say, and the rest of us just have to live with it?

I don’t see why not; if one or both parents are illegal aliens that, in my mind, makes the baby or babies all illegal aliens and subject to immediate deportation.
The Amendment was originally interpreted by the SC to insure that the children of slaves (not brought here voluntarily) were granted citizenship and subject to all the laws and rights of any ordinary white citizen.
It was not intended to provide a welfare scam to illegal aliens in the 20th and 21st centuries.

I believe that any person who, while present on American soil, can be detained and subject to the legal processes of Federal courts is “subject to the jurisdiction of the United States”. This excludes persons with diplomatic immunity (obviously).

I believe XIV has to be amended to end birthright citizenship. Ratification of such an amendment by 38 states is a certainty, it is equally certain that Congress would never submit such an amendment to the states.

My guess, or maybe hope, is that, if and when Trump get’s the nomination, one of his campaign themes will be

“I’m running to make America great again, but I need a Congress that will work with me. That means a Republican majority, but it also means new Republican leadership. Boehner and McConnell are going to have to go.”

Possible or not isn’t relevant in politics. Walker is finally learning the most important lesson of Trumpolitics: Talking a big game is ten times more important than having a record of conservative accomplishments. Talking the talk trumps walking the walk.
