He is correct. The question then becomes, since it is Clinton’s private server, someone with access to Hillary’s email has committed a felony and has violated several National Security regulations. Which means that person can and should be tried, convicted and sentenced according to the law.
In saying that Professor Dershowitz, since it is National Security, and not turning that person in also constitutes a felony offense, would it then be safe to say that Hillary, holding onto this information for almost two years is guilty of that?
Finally Professor Dershowitz, let’s take your first sentence and parse it, because that’s what rats do. “Her Private Server.” Let me reiterate....HER.
It is simply beyond plausible to suggest that a sitting Secretary of State was not aware that classified information could and would be sent to her by email. There is no way she could do her job without routinely reviewing classified data of the highest levels of sensitivity.
None of the possible explanations exonerate her.

So the SOS has no notion that the material they are looking at might need to be classified?! Dershowitz’s observation may be legally correct, but that just saves her from a jump suit. It doesn’t exonerate her from be “responsible” for the breech. It either displays total incompetence or a blase attitude toward U.S. security. Either should be sufficient to disqualify her from being CIC.
I would like to hear Mark Levin’s opinion of this assertion by Dershowitz.
