Tom... One or more jurors may have lied when the judge asked them if they could impose the death penalty if Holmes was found guilty of first degree murder.
My grand daughter was murdered in March 1993. One juror lied when the judge her the same question. She wouldn’t agree to first degree murder so she wouldn’t have to vote for the death penalty.
Problem is there’s no remedy for this misbehavoir.

Was on a murder case jury years ago. We were asked during pre-trial screening whether we could, given the facts, rules, etc. give the death penalty.
When it came down to it, at least 2 could not do so, even though they agreed it was merited.
