I would probably say they are more “honest” not “moral”. Both situations are immoral, but I guess honesty always counts for something.

IMO, anything can be moral under certain considerations (and with future developed technologies) as long as all involved are honest and aware.

Theft by deception can NEVER be moral, no-matter what technology is developed. By definition, at least one party is always deceived.
