GOP Senators Lead Push to Allow States to Impose Internet Sales Tax

Republicans in the Senate are leading efforts to pass legislation that would allow the states to impose a sales tax on online transactions.

Sen. Mike Enzi (R-WY) has proposed the Marketplace Fairness Act (MFA), which would allow states to "collect and remit sales and use taxes with respect to remote sales.” The bill includes an exemption for companies whose gross remote sales are less than $1 million per year. The legislation enjoys support particularly among legislators in rural states who believe that online retailers are encroaching on sales made out of traditional storefronts. […]

This is not the first time Enzi has pushed for an online sales tax. In 2014, he was able to pass the bill in the Senate by combining it with another bill called the Internet Tax Freedom Act (ITFA). Conservatives supported ITFA because it prohibited taxes from being imposed on Internet access service. However, the package never reached the floor of the House for a vote.

While Enzi’s bill stands to pass the Senate with bipartisan support again this year, it still faces strong opposition from conservatives. …

Any new tax these days are for growing government and nothing more—aside from attacking the family constantly, that is, which a growing government always does.

Article 4 Section 4 of the Constitution says that the federal government must “guarantee to the states a republican form of government”. That more than suggests that it should protect the states from a socialist form of government. Of course, given how socialist the federal government itself has gotten (thanks to the seventeenth amendment), that part of the constitution has not stood for a long time.

And that makes me think that the states should provide the processing of their taxes.
An order from a state comes in and a request to the state is sent for processing and they provide the tax bill.
Simple, completely automated.

I’m a firm believer in sales taxes. Hate ‘progressive’ taxes.

When is the GOP going all-in for gun control? That is the only liberal position they are missing.

RE :”Internet sales tax is a complicated issue. There is nothing in their nature which should make them exempt from taxation. However, administration of the tax is going to be extremely hard to implement without imposing huge burdens on small internet business who cannot afford to hire a professional accountant to keep track of all the tax law changes. I smell the AICPA behind this”

Big $$$ corporations like Walmarts and Amazon are pushing for this, and they give these treasonous Senators their orders, not us.

Amazon ALREADY collects state sales taxes for well over half the states.(including mine)

Why?

They have a physical presence in those states.(distribution centers)

The GOP really wants this to be their legacy of GOP control of congress? Collecting state tax enforcement across state lines?

I cant imagine voting in the 2016 general election if they pass this.

Well technically there always has been an Internet Tax, in the form of Use Taxes.

You do pay Use Taxes on your online purchases, right?

I think that many are currently being disabused of the notion that "they would hold their feet to the fire" is still an actionable reality (actually hasn't been for some time).

The ONLY thing that the establishment needs (for the most part) are the VOTES of citizens. The resources needed for re-election campaigns can all be bought by the $$$ from the lobbyists and crony organizations. The phone calls, faxes, letters from disappointed citizens may just as well be directed to /dev/null for all they matter...

Once your give them the only thing that they need (your "lesser evil" vote), you have absolutely ZERO leverage to use against them..... and they KNOW IT!!

The Board of Equalization of the State of California has over 100 publications to explain how sales and use taxes are to be determined.

I have been a seller out of my home in California and did not find the system at all complicated.

Of course, many of these are not going to be applicable to an internet business but someone who has reasonable knowledge in that area is going to have to make that call and the business owner is responsible if the wrong call is made.

Whoever writes that ap and guarantees it will make it easy. It's guaranteed to happen, and quickly.

If an internet business is responsible for collecting sales taxes, would they not be subject to audit by all these taxing authorities?

The blazing brownshirts from California will have a hell of a time making any kind of net revenue out of collections from small businesses out of Stae. Larger entities have all the shipping manifests and accounting records already computerized. So if they are using application software to do the calculations, I really don't see it as a big deal. They already have to do it with freight rates.

Walker is the most conservative candidate with proof. I am sorry you are pissed off at Walker for banning abortion after 20 weeks.....hell if you can’t get an abortion before then your pretty dumb anyway.....you will live after all you said you’ve been involved in abortion and support for, for years. Walker will screw your devotion to killing babies big time. Sorry about that.

Thank goodness we elected all these Republicans!

When do they all magically change to conservatives, again? I keep missing how that was supposed to work.

I do - actually, my wife tallies up all the untaxed internet purchases when we file our state tax return and we remit the appropriate amount. I don't like paying taxes but I try to follow the law when possible. This is one of the fairest taxes out there.

Of course, they are. Anything that makes life difficult on their competition is okay with the big boys.

Rush was talking about this earlier today regarding the Uber taxi services and the push-back from the taxi cartel, using the NYC mayor to push their side.

I have been a seller out of my home in California and did not find the system at all complicated.

Did you collect sales tax from your customers in all the other states and cities which collect sales tax? Did you you file all the appropriate tax returns and remit the collections to the appropriate taxing authorities? Businesses are fine if they only have to deal with one set of laws but having to stay up to date on all tax laws across the country is what is being balked at. If seller's state sales tax law applies, no issues. However, what has been proposed is that the buyer's state sales tax law applies which creates all kinds of issues.

There are 47 states which have sales tax. If a business had to file quarterly in those states, that's almost 200 tax returns which have to filed. Most states require a monthly filing once you cross a fairly-modest threshold. Cross that and the work load goes up by a factor of three.

A couple of nice little computer apps are not going to make everything a-okay. In my mind, it is an unreasonable burden to place on small businesses. It creates an administrative nightmare and hinders actual productivity. Filing forms is not productivity.

"It’s probably the mom and pop local shops that are pushing for this in Wyoming. But it doesn’t change why it’s a bad idea."

Yes, retail businesses that don't produce anything useful. But local governments treat them as the end-all, be-all of sustainable revenues, which they are not. They are not manufacturing shops.

Zoning in rural areas against, new, small manufacturing shops should be abolished, as should onerous fees and outrageously high property taxes on small businesses.

State and local government folks should be deposed in favor of those who would work much harder at much lower pay to do useful things (like maintaining infrastructure).

Why do we have a GOP majority in the Senate if they’re just going to be DNC-lite?

Why doesn’t Enzi demand lower property taxes, lower federal taxes, an end to the anti-job tax policies against workers, and judicial reform?

It’s the spending, not the revenue. They always overspend. No more money for government. Privatize it if you cannot run it on the money you have.
