I just know now the latest trick police now have in their arsenal to take a look see at drivers. Tailgate them, and when they move over, then nab them for not signaling. Most people get nervous when a cop car is behind them, and will move over without signaling, and the cops can use this against us. I have moved over when a cop car is behind me, but I have signaled. Just know that this is something they are probably now teaching in cop school as a way to do a visual search of your car legally, and to hassle you if need be.
There was no reason to do a U turn and tailgate this girl.
I think with apps like Waze, it is much harder to write speeding tickets. Now cops have to provoke a driving infraction.

Since the death is unrelated to the traffic stop then what I am saying is that the family will be unable to sue the cop for the traffic stop because he did not violate the law. Both the cop and the State are immune in that instance. Now whether the County jail failed in some aspect of her care or security is a different matter, which remains to be seen. If the jail messed up somehow and violated the law or State regulation then they could still be sued, but that is a different situation than the traffic stop.

That depends on whether the County jail failed to follow some law or regulation. I don’t know if that is the case or not since that info has not yet been released. The cop is not liable simply for putting her in jail so he is immune since he did not violate the law.

I’m not suggesting that at all. I only stated that the family will not have any luck suing DPS or the trooper for the traffic stop because he did not violate any laws and is therefore immune. They may be able to sue the County, but that will only impact the taxes within that one county. However, if the jail/jailers did not violate the law or State regulation then they too will be immune according to TX law.

I think if one of the people that you mentioned was pulled over then they would be familiar with the law and would actually calmly comply. Sandra was hostile and violated the law. The people you mentioned would have acted proper and listened to the cop so the entire situation would have been better.

Apparently she ran a stop sign, and then when he got behind her she also changed lanes with no signal.
People break traffic laws all the time, all day ever day.
And you know, just because a person may provoke you, or bait you, doesn’t mean that you have to “be” provoked or “take” the bait.
She chose to respond to being pulled over by police, which happens to people all day every day, in a manner that didn’t work out well for her.
And then she chose to kill herself.
It would seem to me that she has a problem with making good decisions.
Or had a problem at least.
Not about her or the cop or what happened. I don’t know either one of them. They don’t affect my life. Neither one of them is any skin off my back.
Just a story in the news among many.
It is entertaining to watch people cry about it though. It’s also an interesting demonstration of how stupid people are and how emotion completely replaces rational thought.

See there you go again making assumptions. I am not racist in the least bit. You are the one that played the race card and claimed that the cop would be a target for blacks. I merely pointed out that in TX the mood is against the behavior of the blacks in these situations and against blacks rioting. It doesn’t fly here in TX. That is true and doesn’t mean I’m racist.
You’re also a hypocrite. You claim a few bad apples make all cops evil, but you claim racism when it is pointed out that a majority of all crime is perpetrated by blacks despite their much smaller populations. Yet you don’t understand that those bad apples also ruin it for the entire group.
I’m sorry you a bad experience with a cop or your husband did. However, none of that makes a difference in this case except demonstrating your own bias. This cop did not violate the law. He may have been rude, but that isn’t a crime. Regardless of her attitude, Sandra did violate the law...several times. That is the difference. Had he violated the law then I would be on your side regardless of his or her attitudes, but he didn’t.
You also need to understand that the public may pay his salary, but that doesn’t mean that he acted improper. Most of the public, here in TX, that does actually pay his salary, sides with the cop and not the criminal in this case. He works for all of them and not just the one that he happened to pull over so he has to base his actions on the group priorities and not the individual. Just like you complain about him enforcing traffic laws. Yet, the public that pays his salary has hired him to do just that. Just because you or Sandra didn’t like it has no bearing on the situation.
You don’t have to vote to increase taxes to support the cops since you are clearly discriminating against all cops. However, you also don’t have any right then to complain when the cops are slow to respond or have budget restrictions that prevent them from being effective against crime. Also, the next time you are the victim of any crime, please don’t call a cop. I’m sure they have much more serious matters to deal with than your petty problems.
You know as well as I the dead woman’s family will sue the daylights out of Waller County and other agencies for millions and WIN.
And this will clearly contribute to higher taxes for those folks in Texas....It’s not that hard, just admit it.
I like the part where this very unprofessional cop with the heavy badge returns to her vehicle with a signed warning ticket...The stop was all but done. And then the cop demands she put out a cig while she is sitting in her own private vehicle...
This guy intentionally escalated the situation which he used that as an excuse to put this women in a cage.....
This insane incident also made her miss her first day of work on a job...

If this cop pulled over a Waller County Supervisor, the Tropper would have bent over backwards to kiss a$$.

Apparently, the cop wasn’t done because he had not released her. She is detained until he tells her to go. Since neither of us was there and we haven’t read the full report yet, we still don’t know what the cop’s motivation even was.
Like I said, whether they can sue or not depends on what the investigation yields. If not laws or regulations were violated and she just killed herself then the family can NOT sue. Our law even prevents them from bringing the lawsuit. However, if the jail violated any laws or regulations then the family can and probably will sue.
Please keep in mind though that the judge and/or jury will be selected from Waller County so whether they win is pure speculation. However, the any possible lawsuit would have to be centered around the time she was in jail. The traffic stop itself would not even be admissible in court since it had NO bearing on her death. If the family wins the suit then, yes, the taxes in Waller County would increase, but that would not impact the entire State.
The family can NOT sue DPS or this trooper because our laws prevent it and make them immune since the trooper did NOT violate the law. It isn’t a matter of opinion. It simply can’t be done in TX.
You can say that the cop was a jerk and intentionally escalated the stop until your blue in the face, but that is a matter of opinion. The fact is, he still didn’t violate the law so he is still immune. Even if DPS fired him for policy violations, he still is immune because he didn’t violate any laws. No amount of silly personal opinions will change the black and white of the law.
Apparently you’ve never dealt with TX DPS. Troopers have been known to give their own mothers and wives tickets and since this Trooper works for the State and not Waller County then he has no allegiance to any county official.
Why sue Waller County and other agencies? What did they do?
Maybe they should sue Sandra. She is responsible for her own death after all.
