(CNN)Anger over Sandra Bland's death in a Texas jail has boiled over after newly released video showed what happened at the traffic stop that led to her arrest.
Now, many question whether she should have been arrested at all.
The dashcam video shows Texas state Trooper Brian Encinia pulling Bland over July 10 for allegedly failing to use her turn signal. What started as normal conversation gets testy after Encinia asks her to put out her cigarette.

None of his business where I am coming or going.
Those from BLM know EXACTLY how to act up.
The system is rigged, bloated, corrupted and run by armies of criminal bureaucrats. Do you suggest I write my corrupt government officials and complain? Maybe wave a sign and protest? Should I call my corrupt non-representative representative to hear their hired mouth piece spew canned responses?
Gezzz..
1. Traffic is irrelevant cause she still violated the law
2. It is not Orwellian and you’re refusal is just immature. Just be prepared to be sitting there a long time and to exit the car then. Also remember that you made that choice.
3. He isn’t suspended. He is on desk duty for a policy violation; not a law violation. He is not in trouble for asking her questions. And besides, look at her...her actions got her arrested. I still think he won that battle.
4. People attempt to mask MJ with air fresheners, cig smoke, and cloves all the time.
5. The cops attitude is irrelevant as long as he is still operating within the law. You may not like it, but you still have to follow his lawful orders.
6. In TX, the law states that any vehicle on a public roadway is not entitled to privacy protections except in the case of searches. The cig may or may not have had relevance to his investigation. His motivation has not been made public so neither of us know otherwise.
Maybe instead of insulting the cop, maybe you should try riding out with one. People use cigs to burn cops all the time and sometimes just as a distraction to get to a gun or knife. Again, you’re talking about something that you know absolutely nothing about.
This was DPS, whose main focus is traffic/drug enforcement on the highway. The issue that you’re referring to is Dallas PD. Two different departments with different jobs and different enforcement priorities.
That would be like asking why doesn’t a nurse perform surgery like a doctor because they’re both medical professionals.
You may say it is none of his business, but the law disagrees with you. He will follow the law so I’d advise you to as well or risk the consequences of your own making.
How you attempt to change the law is your business, but don’t get ticked that the cops must enforce laws that you dislike. If you fail to follow the law then you reap the consequences of your own actions. If you don’t have to follow a law then why does anyone have to follow any laws??? Wouldn’t that be anarchy?
“Just fyi...the cop should approach the car and state something like the reason you were pulled over is because you failed to use your turn signal when changing lanes.
Exactly so.
They are not supposed to walk up to your car and ask you where you are going, He didn’t pull you over because he was curious as to where you were going. They are not supposed to ask you to guess why they pulled you over. If you say well because I was speeding? You have now admitted something. Its best to just not answer those questions and comply with what you are required to do which is show ID etc. Tell the officer your name etc. I would not be a smart mouth that’s just my philosophy. But I will also deflect a question I don’t want to answer. Or just stay quiet. Which you have every right to do.
Its a personal thing. It does not make you an azz to refuse to politely answer a question. You always have the right to remain silent. That your right.
The woman violated a traffic law. A law enforcement officer stopped her. She was impudent & provoking. (The way which she was acting; he may have seen her cigarette as a potential weapon.) - I wonder whether her combative manner might not have continued with other jail employees. Did she commit suicide?
Her death is not related to the traffic stop. This cop had no access to her jail cell so the two are not related. She went to jail for fighting the cop; not for refusing his orders. She died because she killed herself.
Trying to link the two incidents is like saying John Doe died at home of a heart attack because he got a speeding ticket two weeks ago.
Yes, they are supposed to according to training, but they are not legally obligated to say it the way I stated.
You do have the right to remain silent, but the cop also has the right to order out of the car, call the drug dog, and run your full history as a result of your silence. It is his discretion and he may or may not do it, but he legally can. Just don’t get mad if he does it because your actions, though legal, caused his legal response.
If you cannot defend yourself against a cig when you are standing, and the woman is sitting behind a car door seat belted in, you should not be a cop. You are a pansy, not a cop.
More BS. It's like you live in the 1950s. Weird.
Government is corrupt from the top down. Government enforces what they want to enforce. Most paying attention get it.
I personally avoid government and their agents at all levels like the plague or as much as humanely possible. There is very good reason for this. This is my advice to all.
I have a news flash for you the cop can order you out of your car and call a K-9 if you tell him what kind of jelly you had on your toast this morning and you are on the way to Grandma’s house.
Everyone has the right to decide what questions they will answer during a routine traffic stop. Cops should not be on fishing trips just because you failed to yield the right of way. They don’t need to be asking you where you were going its none of their business.
The police have a job to do and they are not your friend. Just remember that. Be polite and give only information you are required to give.
1. You really need to learn about TX law enforcement BEFORE you make silly statements. This police force, DPS, is also call the Highway Patrol for a reason. They enforce traffic/DWI/Drug trafficking laws on the highway. That is their sole purpose. They do not usually deal with B&E, since that is not their State mandate. Highway Patrol in any State deals with the highway and not local city crimes.
2. Yes, you will lie, which is why the cop will ask you questions to try and catch that lie. That is the sole purpose of the questions. So you may not like the questions, but the law disagrees with you. If you don’t like the law then change it. Otherwise, you must comply with the law.
3. I don’t think him being marked by black people is an issue in TX. There is a reason blacks don’ riot in TX because they will be shot by the cops and the citizens. People in TX are generally tired of the lies and abusiveness caused by blacks. Texans are tired of their entitled behavior so good luck with that. We don’t put up with that crap here.
4. Cops are getting bad press cause of the media pushing the lies of the black victims and so far, in nearly every case, the cop has been vindicated by the courts and juries. I think blacks are the ones getting the bad reputation for constantly lying and being disrespectful to cops and any authority.
5. He may have been a jerk and he may have wanted to get her angry, but that doesn’t matter. She is responsible for her own actions and she is required by law to comply with his lawful orders. She violated the law multiple times. The cop may be a jerk, but he never violated the law.
What gives her the right to violate our Texas laws?? Just because she wanted to or felt entitled or didn’t like his attitude?? Sorry, but that doesn’t fly here in TX.
Again, your ignorance of TX law and law enforcement is very telling.
I don’t disagree that much of the government is corrupt, but what is your solution??? Disobey all laws?? What if I want to disobey the law to have car insurance and then I crash into you? Oh, well, the cop should just let me go and not enforce any laws?? Do we just pick and choose which laws to follow and/or enforce?? Isn’t that what conservatives are hammering Obama about??
Please tell me...what is your solution??
I agree. The cop has the discretion to do those things anytime, but most won’t if you’re polite and respectful. In fact, most cops will go out of their way to be polite and respectful back to you.
Since you’re on a public roadway and your DL is a privilege, the cop has full authority and rights, under the law to question you. You have full authority to stay silent, but you can’t get mad if that backfires on you.
Oh stop trying to pick a fight. :-)
Again, your ignorance of TX law and law enforcement is very telling.
Hey gringo, we never got the memo. We don't need your stinking memos. Save that gringo crap for your estúpido citizens.
Everyone must respect his authora-tye! He said “Get out of the car” and by God she should have gotten out of the car and don’t ask why. Because cop told her to! If he had told her to kiss his boots she’d damned well better do that, too.
This woman was pulled over for not signaling. I drive that road all the time and there are always speeders but he catches someone not using their turn signal. She won’t put out her cigarette so she ended up in jail. That’s the bottom line! Then she ended up dead.
In this day and age I ALWAYS give the citizen the benefit of the foubt. Because cops are out of control!
