I disagree.
She is guilty of contempt of cop.
Did she refuse to sign the ticket?
She refused to put out a cigarette.
Dead now.
Justice?
Who killed her?
There was no damn reason for him to even ask that she put her cigarette out.....she was inside her own damn car.
That was a pure power trip.
She was only going to get a warning, but couldn’t keep her mouth shut.
She resisted arrest immediately.
She had a permanent chip on her shoulder.
Irrelevant. When a police officer orders you to get out of the car, you get out of the car. He was only giving the nutcase a warning before she became so belligerent.
Prior to this, she posted a video on Facebook saying she was mentally ill. She later hanged herself in jail.
Police are not required to explain themselves or their actions to you or any other person they detain or arrest. A failure to explain their actions to a citizen, either out of malice or ignorance, does not mean a lawful order can be ignored. They are only required to justify their actions in criminal and/or civil court. Do not mistake a lack of explanation for a lack of grounds. Only refuse to identify yourself if you are absolutely certain you stand on solid legal ground. Do not attempt to stand up to police officers if you aren’t equipped with enough knowledge to make a safe determination of what you’re legally required to do and are prepared to endure a false arrest and charges. Any and all resistance must be passive. Never physically resist an officer (exceptions for extraordinarily extra-legal actions notwithstanding). If your rights are violated, seeking compensation will be hampered by any “bad” behavior on your part. Don’t make your lawyer’s job harder than it has to be.
She hanged herself in jail a few days later. The video proved she was alone in her cell.
Well said.
I am on her side. The cop was the jerk. He escalated it. Then later he claimed he tried to calm her down. He lied. He was yelling at her. He started it by asking her how she felt and if she was angry. Of course she was angry. She was getting a ticket. She said she moved over to let him past and then got pulled over. So what if she was angry. He then yanked her out of the car. Yes he yelled at her to get out of the car first, but why did he do that? She should not have been ordered out of the car.
How she died I do not know but the cop is the reason it escalated to an arrest. HE is the jerk!!!!
Bringing Obammys Chicago attitude down to Texas don’t work.
I agree with her that she should not have had to put out her cigarette just to receive a failure to signal ticket.
Yea, sad story.
But still, why order her out of the car?
Bad attitude? Is that enough to start barking ‘legal orders’?
She did not get mouthy until he drug her out of the car.
Dumb officer, IMHO.
Why was she arrested? She didn’t signal for a lane change. She resisted because it was unreasonable.
Considering that she killed herself, and that this is evidently back up by video tape, I fail to understand how the poster who I asked that question to asks if this is justice.
This really doesn’t have anything to do with justice.
If she killed herself, then she killed herself.
I guess she didn’t want to be here any longer.
She was answering HIS question. He escalated it.

The stop is justified and she is “required” to abide to lawful orders from the officer at that point (including putting out the cigarette). He was going to give her a warning and she started mouthing off to him. Did he handle it perfectly? Realistically, any of us who mouth off to a cop like that are going to get detained and probably drug down to the jail to cool our jets.
They may not have to explain, but they should explain. Given the news of the last few months I would have though he would have bent over backward to explain rather than accuse her of “seeming like she was mad...” She said why she was mad. She moved over to be polite and then got a ticket. But she accepted it. Why did he order her out of the car? Was it just because of the cigarette? That is stupid. She did not understand why being unhappy about a ticket escalated into an arrest. I don’t understand either. That cop was a great big jerk and should find another form of employment.
