Per Article 3 Section 3, he is a traitor, especially by his actions.

Per Article 2, he's not a citizen, so he can't be a traitor, at least not to this country.

He’s already been POTUS, so it’d take the entire stupefied USA to realize that and thus classify him as an enemy combatant.
