Sucks, but that is the way our system works. That actually makes it worse though politically, the guy has nothing they can sue for....if he has anything in Mexico I suspect the family would have to go down there to sue.

She might get a settlement nonetheless, seeing as how political this case is apt to become. I agree with you that a judge would dismiss the case before trial on grounds of no duty to an individual member of the public, and/or immunity.
