I keep reading this observation that government should get out of marriage altogether.

The thing is that laws and the courts have a role (and a legitimate one) in the dissolution of marriage. Government is involved and there really is no practical substitute (something like arbitration will lead to uneven and unpredictable results - there needs to be laws to give stability to the process).
