Only a legal President can appoint justices to the court. Congress approving is based upon everything being legit. Congress can vote all they want but CANNOT appoint.
The Senate has to ratify, and at any time during those processes, the Republicans could have shot them down. But they didn’t, with the usual pathetic excuses.
But it hasn’t been established legally and officially that he’s a usurper.
