An attorney for two men arrested in the May 17 Twin Peaks shootout between rival bikers says his clients are being held illegally and is seeking to replace all McLennan County judges connected to the case.
Austin attorney Adam Reposa alleges in motions filed Tuesday that the charging documents filed against his clients, and the 168 others jailed in the chaotic melee, are legally insufficient.
He also claims that the $1 million bonds are unreasonably oppressive and that the judge who set them and the judges who, so far, have not reduced them have shown bias and should be recused.
Reposa represents Jimmy Pond and Thomas Paul Landers. He said Pond, a mechanic from Hays County, is the sole supporter of his family, which includes a disabled wife and autistic son.
Besides the recusal motion, Reposa filed an application for writ of habeas corpus, alleging a client is being held illegally and without proper cause, and a motion for emergency release so Pond can go home and take care of his family.
After the shootout, in which nine were killed and 18 wounded, Reposa said officials commandeered the Waco Convention Center as a makeshift holding area while they tried to sort out the magnitude of the event.

That’s why a change of venue is appropriate. The judicial part of this sorry mess needs to be far enough away from Whacko so as to give those arrested a decent shot at a fair hearing. And I’d like more specific info on this story that the local “judges” are seeking hold harmless agreements from those arrested in exchange for bail reductions or outright release. That’s simply completely un-Constitutional. I’m no fan of the ACLU, but they need to roll up on this whole sorry deal.

And so far as I have been able to determine, we still don’t know if any biker even shot at anyone, let along killed him. And if there were any exchanges of gunfire between the cops and the bikers. The evidence to date, seems to indicate that the cops just shot whomever was in their field of view at any moment. “Hey Barney, that guy has a pocketknife on a chain, shoot him!”
I was Born in '61 so I have limited info on that RAT BA$$TURD BUT I NEVER LIKED ANYTHING ABOUT him starting with when I saw a clip of him landing in AF1 at NASA in Houston and looking out and saying "My Planes" or something to that effect.
Still no release of video, no forensic details about who shot who.
Waco has stepped in it so big they will spend the next decade trying to extract themselves from the hole they have dug.
Wrongful death lawsuits are coming and the chances the forensic evidence is going to support the police is looking really slim.

Yes...and more of those arrested will be released after their bail hearings on Friday, but you’re dead wrong about the number of lawsuits or the effect they will have on the city of Waco.
No release of forensic data and no video. Why? Well aside from the obvious that it doesn't support their story I would add in the back of their minds they are very very worried about those unfortunate cell phone videos that have a habit of showing up once they commit to a bogus coverup. they are thinking if they wait long enough and nothing shows up they may be in the clear.
The Waco PD is in full damage control mode. Even the judge that arranged the bail is in hot water.
Many of these cases are likely to seek a change of venue which will put the Waco PD cabal out of the sphere of influence.
I don't refer to them as a cabal lightly either. The PD, JP and all acted in exactly that manner. They have been caught red handed flat out lying about those they arrested. The press reports were slanderous, the warrants were invalid, the bail was completely unconstitutional.
This is going to go as far or farther than the Branch Davidian incident. Unfortunately the Waco PD are going to take the heat this time.
