An attorney for two men arrested in the May 17 Twin Peaks shootout between rival bikers says his clients are being held illegally and is seeking to replace all McLennan County judges connected to the case.
Austin attorney Adam Reposa alleges in motions filed Tuesday that the charging documents filed against his clients, and the 168 others jailed in the chaotic melee, are legally insufficient.
He also claims that the $1 million bonds are unreasonably oppressive and that the judge who set them and the judges who, so far, have not reduced them have shown bias and should be recused.
Reposa represents Jimmy Pond and Thomas Paul Landers. He said Pond, a mechanic from Hays County, is the sole supporter of his family, which includes a disabled wife and autistic son.
Besides the recusal motion, Reposa filed an application for writ of habeas corpus, alleging a client is being held illegally and without proper cause, and a motion for emergency release so Pond can go home and take care of his family.
After the shootout, in which nine were killed and 18 wounded, Reposa said officials commandeered the Waco Convention Center as a makeshift holding area while they tried to sort out the magnitude of the event.

“Have you seen the pictures of the ladder truck that was used to search the roof of TP for “evidence”? Now it’s quite possible a they think someone may have thrown evidence up on the roof but the roof is quite high so it would take a big and obvious throw.”
Dude, it is a one story building. Even my 11 year old granddaughter can toss it that high!
Are you implying that your big burley biker buddies are weaker than my granddaughter?
This particular account was from a guy that claims he was there, but was able to flee the scene and avoid arrest. As you point out, it's as credible as any other account.
I'm withholding judgement until the evidence is released. I think the official story is questionable, primarily because it keeps changing. In the end, the truth (if it is ever known) will be somewhere in the middle, but people on both sides will point the finger at the other.
I’ve been on this board 3 years longer than he has.
I know some of the people in the Hosp and in jail down there and I know for a fact they are innocent.
Just because these cops have a “BadgeAmericard” and can shoot anybody they would like doesn’t make them right.
There were no doubt a couple of bad actors that day but it doesn’t excuse the wholesale slaughter or the cover up.
Let us see the video, I know we would have already seen it if it cleared the cops. And don’t tell me that they showed up in force with swat and undercover and didn’t bring a camera.
“Get a grip. Again, you paste in a snip in a reply to ME that I did not post.”
uh, notice I said ‘they’ in reference to the embedded link. Don’t be so paranoid.
Frankly under normal conditions it’s hard to drum up huge amounts of sympathy for feuding outlaw biker gangs that knife and shoot each other, push drugs, steal things, and even (gasp) monopolize the business of 1% clubs, but the croc ironically makes it easier with a monomanic jihad on them that verges into crazy fantasies.
Here’s the reality: people who had been patriotic Americans and are dismayed to see where the government is going are more and more likely to sympathize with the bikers, an otherwise unlikely ally. If this is outlaw, they will make the most of it, in an echo of Patrick Henry. Maybe it was symbolic that the actual Boston Tea Party people dressed up as American Indians, and not all that realistically either. It wasn’t supposed to be an effective disguise. They wanted to show the world how wild they would get in the name of freedom.
“Ive been on this board 3 years longer than he has.”
I am not absolutely positive but I think he may have once stayed at a Holliday Inn.
I have heard one supposed statement that 3 bikers were killed by other bikers. The problem with that is the person remained anonymous.
Nearly everyone that could have witnessed the event first hand are behind bars being silenced by what amounts to an illegal gag order with completely inappropriate bond amounts.
Second major problem is the Police have already been caught in multiple lies and outright false statements. This was not accidental. - Police spokesman stated all those arrested were known biker criminals. Truth, 115 as found by the associated press and public records have no prior convictions. - Police stated the fight started inside the restaurant. Truth, video released and viewed by the AP shows the fight starting outside TP. - Police spokesman have made inflammatory and sensationalized statements about weapons recovered at TP. Truth, in Texas it is very likely that most of these weapons were in fact legally owned and possesed. They also had to admit that recovered weapons included pocket knives and swiss army knives.
The Waco police and all involved in this are clearly not being truthful in their public statesments and there actions suggest nothing but cover up.
Exactly. "Texas" Gator is so devoid of rationality, routinely selectively-reading responses, and spouting non-sequiturs that I have gone from suspecting the biker groups were at fault, to wondering if it was actually the police after all.
And he or she is responsible.
“Heres the reality:”
The reality is that most of America see this as a bikers-gone-wild event and as long as decent bikers continue to praise and hang out with those criminals, the more they are seen in the same light.
Repo-sa? Haha that’s cute. Reminds me of the lawyers name in Office Space; Rob Newhouse. Love that!
Did you bother to read the rest of the CTH piece you linked to? Answer the question.
It's also unlikely anyone actually threw stuff up there. Possible but unlikely.
“Nearly everyone that could have witnessed the event first hand are behind bars being silenced by what amounts to an illegal gag order with completely inappropriate bond amounts.”
Several witnesses to the event have made public statements. However, I was informed here that they are all lying because they fear that the police will execute them.

The link you just posted is to a very thoughtful post by “sundance” at Conservative Treehouse. He doesn’t have a dog in this fight and his article is simply a good analysis/assessment based on the the VERY limited amount of facts that are available.
But I must say TexasGator, that when you say “...they have figured out that the police mass execution dog doesnt hunt anymore” and post a link to “sundance’s” assessment so support that statement....you are betraying your lack of reading comprehension and, very possibly, your very limited native intelligence.
Try reading the linked assessment again and THINK ABOUT IT. The involved Obama regime operatives on the scene with their supporting local police imbeciles have painted themselves in a corner and there narratives are increasingly being shown to be unbelievable.
By the way, as a personal point that may be helpful to you, lots of local schools offer night school classes to people who want to improve their limited literacy. You might want to consider something along those lines. That might help you make less of a fool of yourself.
The folks at the Conservative Treehouse are good researchers but they aren't without their own biases. Their lack of interest in the backgrounds of those arrested or the back story on the history of the two gangs involved is telling. They're still a good source of information that doesn't make it into the newspapers though.
You are a troll, a lead-paint-chip-eating idiot. The day you are removed, the forum will rejoice.
But, as Lazamataz has said: your postings on this issue has been largely responsible for my skepticism. I didn't see any reason to question the official narrative, until I witnessed your behavior.
