An attorney for two men arrested in the May 17 Twin Peaks shootout between rival bikers says his clients are being held illegally and is seeking to replace all McLennan County judges connected to the case.
Austin attorney Adam Reposa alleges in motions filed Tuesday that the charging documents filed against his clients, and the 168 others jailed in the chaotic melee, are legally insufficient.
He also claims that the $1 million bonds are unreasonably oppressive and that the judge who set them and the judges who, so far, have not reduced them have shown bias and should be recused.
Reposa represents Jimmy Pond and Thomas Paul Landers. He said Pond, a mechanic from Hays County, is the sole supporter of his family, which includes a disabled wife and autistic son.
Besides the recusal motion, Reposa filed an application for writ of habeas corpus, alleging a client is being held illegally and without proper cause, and a motion for emergency release so Pond can go home and take care of his family.
After the shootout, in which nine were killed and 18 wounded, Reposa said officials commandeered the Waco Convention Center as a makeshift holding area while they tried to sort out the magnitude of the event.

“Most narsty biker meetings never break out like this.”
Most Bandidos’ meetings don’t have over 50 ‘non-member’ bikers show up with Bandidos’ patches on their back.
“From what I have read it seems the police are the ones who did most of the killing it not all. I would not make that bet if I was you.”
From what I read it seems the biker gangs did most of the killing if not all.
I am reading witness accounts. You must be reading from the click-bait conspiracy sites.
What was the next previous shooting feud at a large biker convocation? Wasn’t it the one at Harrah’s several years ago?
Nine men are dead due to an idiotic feud over a patch, money, and pride. Nothing more, nothing less.
If Soros really IS trying to do that, maybe he’s bribing them to throw their integrity away...
It’s kind of hard to steal from someone who is giving away the store.
You obviously didn’t do it.
Nope, I highly doubt that he is. When the dust settles I think we are going to find that most of the deaths were from the police.
Those being held illegally are being detained mostly so that they can't speak to the media about what really happened.
Waco police, the judges and everyone else involved in this negligent use of police force are in full cover up mode.
Nearly all of those arrested that day and being held on 1 million bond are being held illegally.
This is not acceptable for government to behave this way.
The police brought overwhelming firepower to this scene, and overreacted as is the case very often when you have militarized SWAT groups with a mindset that they are at war.
The same ones will be saying the same thing. Too bad they were not around in the 40s, they would have been orgasmic cheering on the Einsatzgruppen.
Someone arranged a double cross for them. That is pretty much the unpardonable sin in the 1%er bible, so to speak.
What we would all like to know is who knew what about this, and when? If not also who instigated it?
What took you so long to get here. It is too bad that you were not around in the 40s, cheering on the Einsatzgruppen would have made your day.
I knew you was a cop.
On a positive note, they will be at the front of the line for their bread and marmalade and a little train ride to relocate. I hope they enjoy the showers.
Myself, I always question authority. Because most of the time it is being abused...
If that were so, I would be a Cossack now! Notice the SS tattoos and patches. Interesting, In WWII the Cossacks were allied with Hitler.
If they was any aspect of the video that favored the police version one iota, it would have been on al major news outlets 24/7 within one hour at the most.
An article I read yesterday said that in such cases (and compared it to the casino shooting) they will use the heavy bail bond, etc. to pressure some of the defendants into plea bargains and providing testimony that benefits the prosecution’s case. As it stands now, they don’t even have enough public defenders to cover the 75 defendants who’ve requested them.
They are still editing it...
Technically they've ALL been charged with contributing to the murder of these men. It's a bit excessive and overreaching to charge 170 men with that crime.
I still haven't seen a clear account of how the fight came to be.
I've read that the Cossacks crashed this event (came uninvited), that the Cossacks were invited and set up by the Bandidos (invited to come there so they could rumble, shoot them point blank in the head, etc.), that it was all a misunderstanding about a parking space, that it was some kind of confrontation about a patch on a jacket in the bathroom.
It wasn't ALL of these scenarios. But they are bikers so who cares, right?
I spent the day immersed in subhuman bliss.
The Milwaukee muscle of love.
God, it feels good to be back in the saddle again.
Assless chaps and all.
:)
Actually the police are doing a jam up job of ruining their credibility on their on without any outside help.
You’d have to go to the Scottish moors to see this much fog, normally.
Maybe if they hold them in silence long enough, we’ll all just forget about it, completely.
