Congressional Republicans have joined the legal battle over President Barack Obamas executive action on immigration, which he announced late last year.
Currently, 26 states have challenged the presidents executive order, which temporarily stops deportations and grants work permits to specific groups of immigrants living in the country illegally.
Senate Majority Leader Mitch McConnell, a Republican from Kentucky, and Republican Rep. Bob Goodlatte of Virginia filed an amicus brief with the 5th Circuit Court of Appeals in New Orleans to counter the executive actions.
Congress has created a comprehensive immigration scheme which expresses its desired policy as to classes of immigrants but the class identified by the (Homeland Security Department) directive for categorical relief is unsupported by this scheme, the lawmakers wrote in their brief. Instead of setting enforcement policies, it created a class-based program that establishes eligibility requirements that, if met, grant unlawful immigrants a renewable lawful presence in the United States and substantive benefits.
So far, 113 congressional Republicans have endorsed the brief, including Texas Sen. Ted Cruz, a 2016 Republican presidential candidate, The Hill reported.
In a statement released on May 11, Cruz said, The president has unlawfully granted amnesty to millions who came here illegally.
In response to the lawmakers actions, the White House released a statement: Though these individuals and groups come from different backgrounds and perspectives, theyre all in agreement that (the) presidents actions are good for public safety and good for the economy.
The court case centers on Obamas two previous executive actions which has granted rights to nearly 4 millions immigrants living in the U.S. illegally.
The first, titled the Deferred Action for Parent Accountability program, halts deportations and gives work permits to the parents or guardians of American citizens and those who are legal residents. The second, called the Deferred Action for Childhood Arrivals program, is the initial concept of DAPA and would assist millions of immigrant children who were brought to the United States illegally by their parents.
Previously, U.S. District Judge Andrew Hanen of Texas agreed with the states by allowing the case to continue and blocking the programs the president tried to put in place without the approval of Congress.
Why only 113?

How many of this 113 disregarded their constitutional authority, and fully funded this illegal action? This is nothing more than theater. These guys are like the kid that encourages another kid to do something wrong, and then claims they told them not to do it when they get caught.

This is the second Amicus Brief that Senator Cruz has filed. The first was immediately filed in support of the 26 State Suit against Obama. This second is to confirm his position.
But McConnell is filing now when it doesn’t matter and when there is a clear contempt violation by Obama of Judge Hanen’s order. In other words, McConnell’s Amicus is for show, done only in the wake of contempt.
A little ‘Conservative” Kabuki for you. Nothing safer than shootin’ one’s right wing stalwart mouth off when in one’s heart of hearts one knows it doesn’t mean a damn thing.

E/O and signing ceremony never happened. Obama was photoed signing "memos" on AF One. Not an "executive action." Why? B/c an E/O comes w/ legal baggage that the conniving Boobamba wanted to evade. Both "memos" are now on the Whitehouse website.

This empowered the secretaries of State and Homeland Securityin consultation with the director of the Office of Management and Budget, the director of the National Economic Council, the assistant to the president for homeland security and counterterrorism, the director of the Domestic Policy Council, the director of the Office of Science and Technology Policy, the attorney general, and the secretaries of Agriculture, Commerce, Labor and Education.
The order was to make a series of recommendations to reduce government costs, improve services for applicants, reduce burdens on employers, and combat waste, fraud, and abuse in the system of issuing immigrant and non-immigrant visas.

The scam works this way: signed Boobamba memos "delegate" to federal agencies orders to come up with plans (that must advance Boobamba's global conspiracy to overthrow the US govt w/ Third World federales and their cadres jumping the US border).
The federal agencies then "invent" Committees to do this (the better to overthrow the US govt). Then "Administrative Rules," after a comment period, will be published in the "Code of Federal Regulations," which magically turns them into law........ using federal fairy dust.
So Boobamba is shielded from responsibility---he doesn't have to take the hit. Behind closed doors, he tells federal factotums what he wants.....and faster than you can say "the combo plate w/ extra hot sauce".....the overthrow of the US govt commences.

THE "DELEGATION" HORROR STORY--A Federal agency MO since 1946. It's down to a science: (1) publish a Notice of Proposed Rulemaking (NPRM), (2) make the comment period really short, (3) stonewall any negative comments, and, (4) publish the rule, which (5) NOW has the force of US law. No Congressman was ever involved, and Boobamba doesn't leave his DNA on it. Yet again, why "Delegation" is ominous for liberty---why the writing of administrative law by federal agencies - is un-Constitutional (hat tip to FReeper Regulator.)
