And I believe that definition falls under negligent homicide if I’m not mistaken- they are charging htem with higher crimes, but I think they will argue for negligent homicide if they don’t have enough evidence for higher crime-

Depends on the state. Maryland law classifies “depraved heart” murder (which is essentially the same as reckless indifference) as a type of second degree murder. In the end, as with many prosecutions, I would not be surprised if they plea down to a lower charge and/or if the prosecution only brings some lower charge to trial. We’ll see, though.
