That's one reason why Bob McCulloch, the prosecutor in the Darren Wilson/Mike Brown shooting, went to a Grand Jury and presented a full case. He knew that he didn't have a conviction beyond a reasonable doubt and knew a trial would cause more trouble.

Once these cops start defending themselves on court, it's going to get ugly. It's not going to be a slam dunk conviction that the prosecutor is claiming now. There's already all sorts of reasonable doubt. I know there are all sorts of ways to murder someone, but to drive them around in the back of a van is not one o them. Negligent homicide, maybe. But overcharging can lead to an acquittal.
