(CNSNews.com) - The House Select Committee on Benghazi will not subpoena Hillary Clinton's email server, because it can't, committee chairman Rep. Trey Gowdy (R-S.C.) told MSNBC's "Morning Joe" on Wednesday.
"Well our committee doesn't have the power -- under our rules, we don't have the power to seize a personal property like that. The House as a whole, that's franky an open constitutional question as to whether the House as a whole has that legal authority, but frankly, we shouldn't have to compel it," Gowdy said.
"You can subpoena but the power to subpoena is only as good as the power to compel compliance," Gowdy, an attorney, said. "But rather than have that protracted legal battle, I don't know why she doesn't just turn the server over."
At her news conference on Tuesday, Clinton said the private email server she used during her time at the State Department "contains personal communications from my husband and me, and I believe I have met all of my responsibilities and the server will remain private."

Well I didn’t call you a shill, and I’m not at all happy with Gowdy. He hasn’t produced results.
Whether or not it is “personal property” is immaterial.
She can’t turn over the server because both her hands are busy giving Gowdy and the rest of the Country the one-finger salute.
Why would a formerly successful prosecutor accept the chairmanship of a toothless, powerless committee that has less power than Aunt Dinah’s Quilting Circle?! Unless it was seen as a way to preen for a gig on SCOTUS, maybe.
Does the committee even have the power to compel people to appear before it? Can it place them under oath? As Archie Bunker would say, “What’s da’ pernt?”

I was discussing that yesterday. If they issue a subpoena, can any FBI agent confiscate it? Will Holder put out a directive for the FBI not to enforce it?

He was never put in this position to produce results. I said before when he was initially appointed,it was a political trade because at the time Gowdy was on the immigration sub committee.

<><> Hillary was a govt employee---ergo, all electronics in her possession were government-issue.

(1) we have Hillary on tape ticking off the number of electronic devices she uses. Fox aired an interview wherein Hillary tells a tech conference in California: “I have, you know, an iPad, a mini iPad, an iPhone and Blackberry.”.....
(2) Fox's Ed Henry reported an interview where Hillary said she deals with all the Technology in her life by having "TWO PHONES."
(3) All of Hillary's electronics were "government-issue" -- meaning they were paid for by taxpayers. She dooesn't get to keep government property.
ERGO, TAXPAYERS DEMAND TO KNOW:
