Regardless of whether it's a good or bad idea, medical marijuana is now defacto legal in Florida. That was the point of my comment.

I don’t rightly know. I think you’d have to see a critical mass of similar cases to reach that point. Facing a judge rather than a jury might likely produce a different outcome.
