Not so if his parents are not here under a visa. that requirement is a part of the 14th amendment. Must be here under the authority of the US Government for the kid to have citizenship.

I am going to say this once to all the people who would like to believe this is correct--it isn't; it is pure wishful thinking.

The possibility exists that you get a Congress which might enact legislation under the jurisdiction clause of the 14th Amendment and you might also get a Supreme Court which might uphold something like that but those are unlikely prayed fors.

Absent a change in the legislative and judicial environment, the Supreme Court at presently constituted is going to hold that any person born in the geographical territory of the United States is a citizen.
