If there was any doubt left, Justice Clarence Thomas ended it on Monday morning.
The United States Supreme Court will end discrimination against same-sex couples this June and even justices who oppose the coming decision appear to know its going to happen.
On Monday morning, Justice Clarence Thomas made explicit what had been growing apparent to observers for months: The court at least a majority of the justices has made up its mind on the issue of whether the U.S. Constitution bars states from treating same-sex couples differently than opposite-sex couples in marriage laws.
In denying the Alabama attorney generals request to keep a U.S. district court order that strikes down Alabamas ban on same-sex couples marriages on hold while the state appeals, the Supreme Court even as it considers marriage cases out of four other states made it clear that the justices will not stop same-sex couples from marrying in the meantime when a judge strikes down a ban.
The cases the Supreme Court has agreed to hear Kentucky, Michigan, Ohio, and Tennessee come out of the one federal appeals court that said bans on marriages for same-sex couples are constitutional.
Since October 2014, when the justices decided not to hear cases from five states where the appeals courts had struck down the bans as unconstitutional, the justices have denied requests to keep marriage rulings on hold during appeals.
Court observers, including BuzzFeed News, see these decisions as a signal of the courts direction. But the court had given no reason for denying the stay requests leaving people guessing.
Alabama Attorney General Luther Stranges request, however, was the first stay application to reach the justices since they had agreed to hear the cases out of the 6th Circuit Court of Appeals. Some including Strange and Alabama Gov. Robert Bentley had hoped the court would treat stay requests differently now that it had taken up the issue.
On Monday morning, though, the court denied the request. Just by itself, the move would have been the strongest statement yet about where the court is headed on the ultimate question.
But Thomas brought the issue out into the open. He issued a statement, in which he was joined by Justice Antonin Scalia, explaining why they would have granted a stay to Alabama the first word from a justice suggesting the expected end result in the matter.
In the short, three-page statement, Thomas criticized the court for look[ing] the other way as yet another Federal District Judge casts aside state laws without making any effort to preserve the status quo pending the Courts resolution of a constitutional question it left open in United States v. Windsor, the 2013 decision striking down the Defense of Marriage Acts ban on federal recognition of same-sex couples marriages.
This acquiescence may well be seen as a signal of the Courts intended resolution of that question, he wrote, referring to the question of whether bans on marriage for same-sex couples are constitutional. This is not the proper way to discharge our Article III responsibilities. And, it is indecorous for this Court to pretend that it is.
The Supreme Court is expected to hear oral arguments in the Kentucky, Michigan, Ohio, and Tennessee cases in late April, with a decision expected by late June.
Given Thomas dissent today, the only real question left outstanding is where Chief Justice John Roberts and Justice Samuel Alito will end up on the ultimate question. Although both dissented in the Windsor DOMA decision, neither has joined Thomas and Scalia in saying publicly that they would have granted any of the recent stay requests.

What else is left for the left to fight for? Obama has said that he and planned parenthood will not yield. They’ve won the right to slaughter the unborn. It appears they’ve won the homosexual marriage war. What do they want next?

If you ask me a great many of theses traitors to our once free republic of a WRITTEN constitution need to be hanged.
Until then its time to start hunting down theses federal traitors in black robes and removing them from office. By whatever means necessary. Until we do there can be no freedom when there is no law, and there is most certainly no law when a judge can simply decide that law established and practiced for centuries is fundamentally at odds with a constitution written and practiced under that same law centuries ago.
This is of course the very definition of dictatorial rule and a free people cannot stand for it.

Ironically this is the bottom line that no set of injustice in black robes can ever change no matter how much they might naively feel it is somehow wrong.
You can’t make an impossible thing possible by declaring it so, You most certainly can never do so by breaking the oath you took in upholding rather than completely rewriting to suit your own ideological feelings.
They call this “marriage equality” but its not marriage at all, theses people don’t even have the foggiest clue what is a marriage its sodomy and aduilty.

it is funny how their supreme dictators in black robes have decided to conveniently given them all their major battle and we just lay down and take it.
I think its because they assume we wont fight, when those dictators speak. Well its time we stand up to those dictators because if we keep backing down every-time they lawlessly weigh in there will never be real freedom or Constitutional law again. Only Ideology imposed by the lawless ones on the bench acting as supreme as dictators.
WE MUST ignore them!, We MUST impeach them!, We must remove them from office and their position of illegitimate and boundless power by whatever means necessary!
We cannot live in a free country under tyrants like them!
This battle is only as lost as our freedom.
There are a couple more things about Sodom and Gomorrah that we think about less
(1) the region failed the Abrahamic bargain (fewer than 10 righteous people left)
(2) if the miracles that Jesus had done in Israel had been done there, they would have repented (what? this industrial strength evil? well that’s what the gospels quote Jesus as saying)
Now this doesn’t mean that America has not been, metaphorically, buggered — and badly buggered. (Think the “squeal like a pig” scene in the movie Deliverance.)
But it does not have to be the manifest end of the story.
Looking at how this travesty has unfolded, it seems very clear that the devil has our number here in the USA about what we worship — and it isn’t God anymore. I will bet a dozen rainbow sprinkled donuts that there will be loud choruses of oohing and ahhing about how “grand this country is” if/when the USSC hands this turkey down. Even among supposed moderates. It will now be seen who worshiped what — and country will, surprisingly, prove to be among the major idols.

I agree, There really isent anything left fighting for when you give up on the foundation of our civilization. Reproduction based marriage.
The civilization is necessarily dammed to fall and we shouldn’t try to stop the inevitable, instead we should try to prepare ourselfs and our families to form cultural isolated units to survive its collapse and rebuild. That means completely and uneveitively rejecting self-destructive lies the ones now imposed from the courts in favor of family values.

I agree, and indeed it is imperitive that we do this and other things to stand up to this increasingly lawless Federal ‘court’ When they start declaring acts hundreds of years old in practice unconstitutional under law also hundreds of years old in practice. There is no room to even imagination their judgement in any way legitimate in interpretation. But rather CLEARLY creative and thus inherently lawless in the nature.
We must resist for the sake of preserving Existing Constitutional law, or there will be no Constitution only the absolute rule of 9 dictators in black robes.
