I hope Klayman files an appeal because his argument for standing is very strong as can be seen in the post #4 link. Any judge who follows the law will grant standing. The links in post #1 have Obama’s response which is very weak in everything including standing.

Obama’s approach is so disengenuous which shouldn’t surprise anyone. His lawyers claim his executive amnesty action is just policy or politics and not law. So because his actions are not grounded in law and are just matters of discretion, no one is allowed to sue him. Klayman and Abbott both demolish this argument of ‘discretion’.

So it’s clear why Obama did not sign an executive order because doing so would put him on the hook legally.
