Exactly. Nothing like a signed contract. Doesn’t do much for spontaneity, though.
Simple - get it in writing beforehand. :-\Even that wouldn't work: "Lack of protest or resistance does not mean consent, nor does silence mean consent. Affirmative consent must be ongoing throughout a sexual activity and can be revoked at any time."

Indeed, a marriage certificate would be helpfully, but today even then it might be rape.
