The states rights argument only works as long as Colorado keeps it within their borders. If it crosses the border, it makes the case for Federal involvement as interstate commerce.
How does it make the case for "interstate commerce" if someone goes to Colorado to buy it? Both the buyer and seller are in the same state.
Except that Colorado’s Amendment 64 has nothing to do with Federal laws. It doesn’t strke down Federal laws, restrict Federal enforcement, or anything of the sort. If other states want to sue anybody, it should be the Federal Government for not riding herd on the States. A true conservative position. /s
If the State of Colorado were doing it you might have a point. But it isn’t so you don’t.
How do you violate Federal law with impunity? I say we not pay taxes or register for the draft or commit wire fraud? Who has the right to violate federal statutes and who doesn’t? This is madness.
exactly, let the feds deal with interstate commerce...it is not up to Colorado to police people who are purchasing a legal product.
by the way I oppose legalization.
That is very true especially considering that marijuana is illegal at the federal level. If marijuana was not illegal at the federal level then Oklahoma and Nebraska would face a probable uphill battle. I think the argument for Oklahoma and Nebraska is made stronger by the federal marijuana law.
