I think the deal is; if “she rapes you” is more like if she initiates the event in her drunken state, you are still at risk of being held responsible for the event, and subject to her bad memory.
It can and does happen.
A fellow being falsely accused of rape, and the woman having forensic evidence of the encounter, would never have been accused had he not been promiscuous. The lesson for us males is to remain abstinent until marriage. Good luck with that, BTW.

False accusations of rape do indeed occur, but that number pales in comparison with actual rapes.
