The administration warned a federal judge Monday to stay out of the debate over President Obamas deportation amnesty, saying decisions about whom to deport fall squarely within the executives job description, which this court lacks authority to review. In its first extended legal filing in one of the court challenges to the new amnesty, the Justice Department says courts have long held that an agencys decision whether or not to prosecute someone or to enforce the law is entitled to absolute discretion.Federal courts sit to decide cases and controversies, not to resolve disagreements about policy or politics, said Joyce R. Branda, the acting assistant attorney general who took the lead on filing the brief.
Ms. Branda said the administration had to impose the new deportation amnesty because immigration enforcement has become too costly in recent years, outpacing the amount of money Congress provides, so picking and choosing which illegal immigrants to deport is the best use of taxpayers money.

Judges have big egos. I'm hoping this judge is proud enough and unprofessional enough to take this personally and to act on that insult.
Ok, so Monsieur Obama via Madame Branda has asserted their role to determine who and who shall not be deported.
But what gives them the right to issue ID Cards, SSNs and confer federal benefits to those illegally inside the United States?
Now we obviously have a dictatorship. Wow.
I’ve always heard “It’s for thee and not for me”. That’s really the way it is today.
I had no idea the president could choose which laws he wants to enforce. Silly me. I thought the oath he took said that he would enforce all laws.
All it takes is the legislature to vote us out and a governor with some balls and Texas is out. Unfortunately the only governor we’ve had with balls in decades was Ann Richards.
Point of order. The citizens of this country have the “most guns”, and it will ultimately be up to us to decide what is “right” and what is “wrong”, period.
The only thing that actually matters is whether or not those who possess the most “firepower” are willing to bring it to bear against the tyrannical Federal Government.
Interesting times, indeed!
No, you got that wrong.
US Marshals back up federal courts. They have the guns and the authority to lock people up including federal government employees and federal contractors.
If Obama orders his guns against the US Marshals, then there’s no question what happens next. But Obama is not that stupid.
” . . . immigration enforcement has become too costly . . .” recently, so we’re opening the floodgates for the US Treasury to pay benefits to > 5 million illegal immigrants. FUBØ!
“The stuck pig squeals.
Got em.
Drive harder.”
Let’s say you were in his position and you were intent, as he is, to do as you please.
1. You have a Congress run by the other side either afraid of their shadows, or secretly complicit with you, who have just caved on everything they said they were going to fight you on.
2. You also have the same congressional “leaders” who have already said that they would in no way ever impeach you.
3. You also have the same congress who found your attorney general in contempt of congress, and he not only didn’t resign but doubled down on everything congress was against. And congress did nothing.
4. You have a congress who was given the finger by some lying IRS underling and that congress didn’t have the balls to arrest her.
5. You have a supreme court who allowed you to rewrite your key legislation without any input from congress.
6. You have a propaganda machine known as the media who will spin anything that happens in your favor.
7. You have a populace who for the most part doesn’t have a clue of what’s going, nor does it care.
And you mean to tell me you’re going to be squealing with fear at what some lonely judge opines about one of your many illegal acts that you’ve already gotten away with??? What army is this judge going to send to get you?
I think the squealing you’re hearing is actually a loud laughter.
Yeppers, this administration is just SO concerned about the taxpayer. FUBO
I’m having trouble visualizing U. S. Marshals waltzing into the White House and putting the bracelets on Obama. Intimidation would work well first.
Great journeys start with a single step.
Every time I read he was a constitutional lawyer I think that all they taught him was how to rule without it. He is flawless in the execution otherwise he would be impeached. I also know he isn’t actually the one coming up with this. Where is the list of people working for him since we can’t prosecute Satan?
Yes it’s obvious you have trouble visualizing much of anything on this topic.
US Marshals DO NOT NEED to go into the White House or onto the golf course to put the cuffs on this sad excuse for a President.
US Marshals will put the cuffs on any federal government employee that violates the Judge’s order including any Social Security employee that issues an SSN to an illegal or to any federal contractor that attempts to make documents and cards for illegals.
The contractor for the Amnesty ID cards is General Dynamics. They can be shut down in a flash by the US Marshal Service. General Dynamics won’t even think of screwing around with violating a federal court order; Not going to happen.
Yeah that ought to play well
ProsecutoriaProsecutorial discretion is he choosing not to prosecute a particular case.
Issuing certificates indication that the recipients cannot be prosecuted is something else, entirely.

When they can do that, then they can prosecute who they
like...
Claire Wolfe’s time of indecision is coming to an end.
All the judge needs to do is to direct his order at supervisors, bureaucrats and staffers at DHS, as well as contractors printing forms and ID cards. We’ll soon see that very few folks are willing to spend a couple weeks in jail waiting for it all to be sorted out for some other guy’s “cause.”
