She was apparently taking the photographs from a public roadway near the base. The helicopter that she was photographing was “inactive” (meaning it was deocrative) and clearly visible from the public space. Indeed, the local justice court threw out the underlying trespass charge because she wasn’t trespassing when taking the photographs.
I used to drive by that helicopter all the time. It’s totally disabled, easily viewed from the road and out there for display. If they didn’t want people to take pictures of it it should have been in a less conspicuous location. It was a stupid arrest and anyone who doesn’t think so is no conservative. They’re police lapdogs who think any arrest is a good arrest.
