On 6-26-13 SCOTUS ruled that key provisions under DOMA as unconstitutional and in turn many state legislatures have overturned similiar laws across their states. As such it is required in these states that judges rule on established laws within their states....yes despicable but it is as it is....change it at the legislative level
So... there is no “law established by the legislature” in North Carolina as you originally claimed.
