Some court will step in and legalize it anyway.
Morgan & Morgan (for the people) will be having a long night. Medical Marijuana and ‘Orange Skin’ Charlie will close. :-)
That would be the ‘right to keep and bear weed’.
Legalized marijuana may come some day to Florida.
But it won’t be written into an amendment to the state constitution.
Que Bono?
the lawyers want it because it removes the superceeding intervening criminal act exclusion to filing a lawsuit.
Not unless the Supreme Court overrules Gonzales v. Raich (2005) or the Congress amends/repeals the Controlled Substances Act of 1970.

I’m against the referendum method of making statutory or constitutional law.
I despise democracy.
48% for marijuana
44% against it
7% too stoned to care!
My poll - Margin of error - We don’t need no stinkin’ margin of error.
On a quick read, I couldn’t pick up why 60% was required. In other states, medical marijuana was a majority vote. What did I miss?
The marijuana amendment in CO is going to be repealed.
So what is your preferred "method of making statutory or constitutional law?"
That Florida is a constitutional amendment, whereas I don't think Washington and Colorado's were.
That, or different states have different rules.
Why would you need a constitutional amendment? Did Florida actually write a pot prohibition into its constitution?
It will be like lotteries and casino gambling.
Once the legislatures realize how much dough it will generate for the state, there will be no stopping.
Florida good news ping.
Medical pot is already available in Florida. This is an attempt to let anyone be a dealer.
Ambulance chaser, John Morgan, and his people, in an attempt to help Charlie Crist get votes (dem GOTV), decided to make this voter referendum a constitutional amendment. In order to become an amendment to the Florida Constitution, the voters need to approve it by at least 60% of the vote. A simple majority will not make the cut. That is Florida law.
So, they didn’t really want it to pass, but thought it might be politically useful to have on the ballot?
Through legislatures.
