An en banc ruling of the Fifth Circuit has issued a stay against last Fridays order striking down Texas voter identification laws.
The Court looked at four key factors when deciding whether or not to grant a stay pending appeal: (1) whether the stay applicant has made a strong showing that he is likely to succeed on the merits; (2) whether the applicant will be irreparably injured absent a stay; (3) whether issuance of the stay will substantially injure the other parties interested in the proceeding; and (4) where the public interest lies.
The first two factors are the most important, and the court focused on them when deciding to issue the stay. First, the court looked to the Supreme Courts tendency to preserve the status quo on the eve of an election in order to protect the process from confusion and misapplication of the rules.
Here, the district courts decision on October 11, 2014 presents similar logistical problems because it will be extremely difficult, if not impossible, for the State to adequately train its 25,000 polling workers at 8,000 polling places about the injunctions new requirements in time for the start of early voting on October 20 or even election day on November 4. The State represents that it began training poll workers in mid-September, and at least some of them have already completed their training. The State also represents that it will be unable to reprint the election manuals that poll workers use for guidance, and so the election laws will be conveyed by word of mouth alone.(continued)

SCOTUS will overrule. You heard it here first. Not 100% confident in my “bold prediction a la NFL Channel” but there has been a major change in SCOTUS over last month. (Today’s abortion stay in TX being another example). Something is going on (no not some sill conspiracy ‘they’ve got something on them’ crap). But their is a clear ideological shift. It is unsettling at best.

These states need to start IGNORE unconstitutional legislate from the bench edicts like this one!
In TX, the ID is free but transportation isn't. The GOP should have arranged for free transportation to pre-empt the argument that the $50 round-trip cab fare for remote areas disenfranchised poor voters.

I don’t understand why this issue is in litigation at all.
Reason being, the Supreme Court has already upheld voter ID laws as constitutional, and not discriminatory, not racist, not an impediment to exercise of our right to vote.
Considering that there is a Supreme Court precedent set, why are there still voter ID law lawsuits? Because liberals aren’t happy? Because there are so many liberal judges out there, who won’t observe the precedent, and give these cases a hearing anyway?????

The court decided to issue the stay in large measure in deference to similar rulings by the Supreme Court that have come down in favor of avoiding last minute confusion and interference by the courts when an election looms.
This is a strong indication that the Supreme Court will not act prior to the election. The circuit court also indicated the the appellate is likely to succeed on the merits which they will consider after the election. Voter ID has already been ruled Constitutional by the Supreme Court, This is just delay tactics and arguments about minor details of implementation in the various states.
Now it’s time to reign in out of control absentee voting and same day registration. There will be voter fraud during the Colorado elections, the key there is to identify it and prosecute and set the example for fixing the law.

Yep, somebody has a picture of Roberts with the metaphoric sheep for sure. That became apparent when he virtually rewrote Obama Care and declared it a tax.
So...those people who don't want voter ID at the polls want us to believe that someone who can't afford transportation is somehow adversely affected by a free ID they must present to vote...at a polling place they can't afford to get to in the first place? Riiiiight.
They will not, in my opinion. This stay is based mostly on timeing as the District Court ruled too close to the election. I think that it will fail on the merits as well. If not in the District Court, then at the 5th Circuit. Those boys and girls in New Orleans don't mess around. Since that ruling will be in line with SCOTUS decisions, the court will not agree to hear it.
It’s because we are overrun with liberals/socialists and they NEVER, EVER give up trying to socialize the country. They will try ANYTHING, no matter how unlikely the prospects of success. After all, that’s all they live for.
Someone has Roberts by the nuts. And they’re twisting.
