This will get tossed by the courts.
If not by the district court it will at the appellate level.
Or the next Governor will (along with the Board of Pardons and Paroles) grant him a pardon.
I’m a Texas defense attorney and I spoke with a Texas DA Friday evening about this case. He was outraged by this abuse of power by the PIU.
It’s clear that the PIU should be brought under the authority if the AG, that way it is accountable to the whole state.
This is what has bothered me for a long time, long before this came up. The PIU has incredibly broad reach over the entire state yet is run by a single county’s (Travis) DA and not accountable to the state’s AG office.
I certainly hope so. The dems probably think this will help their cause at election.
I was hoping this incident could be a motivating factor in getting the constitution changed. Hopefully it'll happen with the next legislative session. I would have thought this would happen with the absurd Hutchinson fiasco but I never heard a word.
Having the whack jobs in Travis County run anything state wide is simply insane. Not saying the AG couldn't be a rascal but at least it's a state wide office.
